1. Agreement to Terms

By accessing and using Blush & Blue ("we," "us," or "our") website and services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our website or purchase our products.

2. Products and Services

Blush & Blue specializes in handcrafted and custom Jack and Jill of America (JJOA) accessories, apparel, and gifts. We offer both ready-made and custom-order products.

2.1 Product Descriptions

We strive to provide accurate product descriptions, images, and specifications. However, we do not warrant that product descriptions, colors, or other content are accurate, complete, reliable, current, or error-free. Colors may vary slightly from images due to screen display settings and the handcrafted nature of our products.

2.2 Pricing

All prices are in U.S. dollars and are subject to change without notice. We reserve the right to modify prices at any time. The price charged will be the price displayed at the time of purchase.

2.3 Custom Orders

Custom and personalized products require additional production time (typically 2-3 weeks). Custom orders are final sale and cannot be returned or exchanged unless defective. We will provide proof or mockup images for approval before production when applicable.

3. Orders and Payment

3.1 Order Acceptance

We reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, errors in product or pricing information, or suspected fraudulent activity. If your order is canceled, we will notify you and issue a full refund.

3.2 Payment Methods

We accept payment via credit card, debit card, and other payment methods as displayed at checkout. Payment is processed securely through Stripe. We do not store your payment information.

3.3 Payment Terms

Payment is due at the time of order placement. For custom orders, we may require a deposit before beginning production. Orders will not be processed or shipped until payment is received in full.

4. Shipping and Delivery

4.1 Shipping Methods

We ship via UPS Ground and USPS Priority Mail within the United States. Shipping costs are calculated based on package weight, size, and destination. Local pickup is available in the San Antonio, TX area at no charge.

4.2 Processing Time

Ready-made items typically ship within 3-5 business days. Custom orders require 2-3 weeks for production before shipping. Processing times may be longer during peak seasons (Black History Month, graduation season, holiday periods).

4.3 Delivery Time

Estimated delivery times are 3-5 business days for UPS Ground and 2-3 business days for USPS Priority Mail after shipment. Delivery times are estimates and not guaranteed. We are not responsible for delays caused by shipping carriers, weather, or other circumstances beyond our control.

4.4 Shipping Address

You are responsible for providing an accurate shipping address. We are not responsible for orders shipped to incorrect addresses provided by the customer. Address changes must be requested within 24 hours of order placement.

4.5 Lost or Damaged Shipments

If your order is lost or damaged during shipping, please contact us within 7 days of the expected delivery date. We will work with the shipping carrier to resolve the issue and will replace or refund your order as appropriate.

5. Returns and Refunds

5.1 Return Policy

We want you to love your purchase! If you are not satisfied with a ready-made (non-custom) item, you may return it within 14 days of delivery for a refund or exchange. Items must be unworn, unwashed, and in original condition with tags attached.

5.2 Non-Returnable Items

The following items cannot be returned or exchanged:

  • Custom or personalized products
  • Items marked as "Final Sale"
  • Items that have been worn, washed, or altered
  • Items without original tags or packaging

5.3 Return Process

To initiate a return, please contact us at [email protected] with your order number and reason for return. We will provide return instructions and a return authorization. Customers are responsible for return shipping costs unless the item is defective or we made an error.

5.4 Refunds

Refunds will be issued to the original payment method within 5-7 business days after we receive and inspect the returned item. Shipping costs are non-refundable. If you received free shipping on your order, the actual shipping cost will be deducted from your refund.

5.5 Defective or Incorrect Items

If you receive a defective or incorrect item, please contact us within 7 days of delivery. We will provide a prepaid return label and send a replacement or issue a full refund, including shipping costs.

6. Intellectual Property

All content on this website, including but not limited to text, images, graphics, logos, and designs, is the property of Blush & Blue or its content suppliers and is protected by U.S. and international copyright laws.

Jack and Jill of America® and related trademarks are the property of Jack and Jill of America, Inc. Blush & Blue is an officially licensed vendor authorized to create and sell JJOA-branded merchandise.

You may not reproduce, distribute, modify, or create derivative works from any content on this website without our express written permission.

7. Limitation of Liability

To the fullest extent permitted by law, Blush & Blue shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

  • Your use or inability to use our website or products
  • Any unauthorized access to or use of our servers or any personal information stored therein
  • Any interruption or cessation of transmission to or from our website
  • Any bugs, viruses, or other harmful code that may be transmitted through our website
  • Any errors or omissions in any content or for any loss or damage incurred as a result of your use of any content

Our total liability to you for any claim arising out of or relating to these Terms or our services shall not exceed the amount you paid us for the product or service in question.

8. Indemnification

You agree to indemnify, defend, and hold harmless Blush & Blue, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of our website or services, your violation of these Terms, or your infringement of any intellectual property or other rights of any third party.

9. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or our services shall be resolved exclusively in the state or federal courts located in Bexar County, Texas.

Before filing any claim, you agree to first contact us at [email protected] to attempt to resolve the dispute informally. We will work in good faith to resolve any disputes.

10. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to this page. Your continued use of our website or services after changes are posted constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.

11. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.
